Terms of Service.

1. Acceptance of terms

By accessing or using Apex Car Exchange, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform.

2. Eligibility

You must be at least 18 years old and a resident of Australia to register an account or participate in auctions.

3. Listing rules

All vehicles listed must be accurately described. Sellers warrant that they hold clear title to the vehicle or are authorised to sell it. Misrepresentation is grounds for immediate account suspension and possible referral to ACCC.

4. Auction conduct

Bids are binding. Winning bidders must complete payment within 48 hours. Default may result in forfeiture of deposits and permanent ban.

5. Fees

$50 flat listing fee for 30 days. No success fees. Platform premium for auction buyers is disclosed at checkout.

6. Escrow

Buyer funds are held in a regulated Australian trust account (Macquarie Bank). Release occurs after buyer confirms delivery or after 72 hours with no dispute raised.

7. Governing law

These terms are governed by the laws of New South Wales, Australia.
